Huawei sues US tech firm InterDigital over alleged unfair license practice

Chinese telecommunication giant Huawei filed a lawsuit against US wireless technology provider InterDigital Inc on Jan 2nd in China, alleging that the company failed to license its intellectual property fairly.

Huawei alleged in the lawsuit, filed in the Shenzhen Intermediate People’s Court, that InterDigital failed to fulfil its obligation to license patents that are essential to 3G, 4G and 5G wireless telecommunication standards on fair, reasonable and non-discriminatory terms (FRAND).

Huawei and InterDigital had a similar legal dispute in 2011 over the same allegations, which led to a multi-year patent license agreement for 3G and 4G terminal units between these two parties that expired at the end of last year. Shenzhen-based company also asked the court to determine a royalty rate that would apply to its wireless products for the next four years.
